An act of fairness also differs from person to person, thus making a compromise an extremely difficult solution, which is why I believe its been left as it is and has been since 2005 and beyond.
In my simplest of opinions: Daylight blindness is an annoyance but suck it up. Dev time's better spent elsewhere, considering that daylight blindness only affects a minority of the playerbase.

If it's just an X second blindness effect on drow on area enter, it should be only a few lines to comment out (in the case of removal of the annoyance).

More of a minor annoyance that would be better served removed or improved on.

I'm gonna have to agree with Selvec. The penalties are fine and represent sensitivity to light enough. The blindess repeats when it's not supposed to and just screws with people for not reason. I know from experience, even walking and following some in RP through a transition with a drow, you have to wait like 6 seconds to keep moving with the group after you pass through. Only way that makes sense is if drow impulsively look up at the sun every time the pass through a transition. And last I recall, they get a bonus to intelligence, not a penalty.

A drow should never get used to the light (that specific feat excluded, of course). I hate to use Drizzt as an example, it makes me cringe really, but he's the only surface drow I can think of right now and he never got used to the daylight, even after years and years and years of being on the surface.
Yes, the blindness sucks. If it annoys you, odds are it annoys your character, too. For some reason it doesn't happen underground, though. I wonder if that's a hint about something?
I'm all for people playing their characters as they want to, but sometimes it just gets ridiculous. In my own humble opinion, if you want to play a character that makes up a severe minority of a given race (i.e. surface drow compared to UD drow), take the negatives that come with it. If I had my druthers, surface drow would be a platinum coin request.

I think you may have misinterpreted.
I think the penalties are fine, the -1 to blah blah blah. It's mechanical blindness that happens everytime you go through an OoC transition(As in one part of the forest to the next) that is annoying. No one's saying drow should get used to light, we're saying that the way its implimented is faulty. If it happened the first time you entered the outside during the daytime, that would be fine. But it doesn't, it triggers multiple times throughout traveling through transitions.

It's true. There's no flavor to being blinded a few seconds every time you enter transition. It doesn't make IC sense either, but that's a secondary concern. More importantly, it's just annoying a poorly implemented. It's also pointless because you're not allowed to attack drow on sight, so that few seconds of vulnerability can't even be used against them.
Heftier penalties in daylight, however, would be fine.
