I am pretty sure I know the answer to this, I just dont want any maragine for doubt. If one wanted to make a character with a feat in one of the 3.5 fareun books, lets use "Servant of the Fallen" as an example, it would need to be a requested first?

Your character can't do anything that you can't do mechanically in-game without either permission of all parties involved or affected, or without requesting something to emulate that ability mechanically.

So yes and no.

servant of the fallen basicly means playing a cleric of a dead god, ie a cleric of bhaal. let me quote what it says.

Quote:
Servant of the Fallen: You keep alive the worship of a deity who has died or vanished. Your faith in this fallen deity allows you to wield divine magic in his or her name.

Prerequisites: cleric level 1, Dead or forgotten god (for example, Amaunator, Bhaal, Moander, or Myrkul) as patron deity.

Benefit: You can name a dead god as your patron deity and still recive your cleric spells normally. In addistion, you can call upon the universal remnant of your deity's power once per day to gain a +1 luck bonus on any single die roll. You can also be raised or resurrected normally.

Normal: dead or fallen deities can not grant cleric spells, so clerics who chose succh patrons do not normally recive spells. Charachters who do not worship active gods in Faerun suffer the fate of the faithless in the Fugue Plane after death.

Special: You can take this feat only once. Choosing this feat changes your patron from your previous deity to the dead or forgotten deity of your choice, and you take no penalties for making this change. If you later chose a different patron deity, you lose the benefit of this feat, but your new patron may grant you spells just as he or she would for any other clerics. See ancient deities, page 41, for a list of notable dead gods, their alignments, and their domains.

Sounds okay to me ^^; I suppose you'll just be a basic cleric without the domain benefits of Amia's prayer, roleplaying your faith in a dead deity. I don't think you need any DM help to do this either, unless you want the luck bonus thing~

I expect that a request would be needed to play a character that is normally not available. I'd suggest a normal special character request.

Most of the dead gods are still worshiped, actually, but another god grants spells, etc. without the worshipers even knowing.

Many "dead" gods are even capable of granting spells themselves. But yeah, I'd say you need to make a request for that, just to be sure. We do approve things like this if they are lore-sound, but it needs some looking into first.

If by dead you mean they were "killed" by a mortal, which is, in the Forgotten Realms, impossible. If defeated by a mortal they simply lose a portion of their power and..something else for a certain time, can't remember specifically and I don't have Faiths and Pantheons to check from.

Only a deity can destroy another diety, but even then they don't exactly die. Their bodies forever drift in the Astral plane (many becoming home to lesser beings), and their sentience fades in and out forever. However, if this happens they can no longer grant spells to their followers because they no longer have a portfolio. Their previous portfolio has either been absorbed by the deity that slayed them or it is forgotten.

Amaunator and Auppenser are two examples of dead deities that have followers who do gain divine spells. They haven't perished, but neither are they living, active deities. (And this is before and unrelated to the new 4e lore of Amaunator=Lathander, which is far less elegant than my truth. >_> )

Well they decided to make corellon a fey deity from what Terra told me, which ruined the fun speculation if the elves were murians that we had going. so I'd be as bold as to say everything with 4e on it is inelegant and poo.

That beeing said, worshipping a dead deity and getting spells for it, still sends you into the nice little wall of Myrkuul, that Kelemvor has to enforce. Om gnom gnom..

Aumanator = Lathander was a terrible retcon since aumanator IIRC died because he ran out of worshippers which would clearly not be the case if he was Lathander.

It was a bit unclear, I think, but it seems they co-existed for a time and perhaps during the Dawn Cataclysm Lathander absorbed an essence of Amaunator. However, there are still cults that worship him and gain spells. After all, Lathander did not take Amaunator's portfolio, so Sun remains unclaimed save for the apparently-dead deity. Deities never disappear for good, though, so even their bodies in the Astral may have divine power left.

Lathander only has Dawn, which is often mentioned in discussions. He's about transformation and new beginnings, which (I guess) is why people both out of the game and in the setting sometimes assume he will become Amaunator, or at least take the role of said deity more completely. The hook's been there for a good while. It makes sense in a way, but the way it was ultimately handled was pretty lackluster and senseless, like you said. Lathander needs to claim Sun eventually, lest Horus-Re make his way into the Faerûnian pantheon and snatch it before his eyes.

Yeah, Lathander has the sun domain but not the portfolio or sphere. And actually, in 4e (Yeah, it sucks, I know) Lathander is revealed to be, or at least becomes, Amaunator. One of those two. I think it was after the Spellplague, which also revealed that Yondalla was truly Chauntea and Sehanine Moonbow was truly Selune.

Yes, and Talos is Gruumsh and Brandobaris is Tymora, IIRC.
