The Just War Treatise of St Hargreve

A summary of the treatise for those which are unfamiliar with its principles, refer to the writings of Vergos for a detailed account. St. Hargreve, was a Tempuran monk, who while understanding the necessity of war amongst civilized beings became disillusioned with constant existence of war across Faerun. His witness of endless suffering on the battle field brought him to turn to the Ilmatari faith for answers. Working instead to lessen the misery of war on the innocent, as a monk of Ilmater he devised this treatise on what he called a Just War. His treatise has been promoted by many faiths who seek to limit the spread of wars of untapped aggression.

St. Hargreve maintained that three conditions should be met so that war may be waged justly.

First and foremost, war can only be declared by the legitimate authority who holds the duty of preserving the common good of a realm. As such, no individual can commit to war without this authority, and it is this authority which absolves those warriors from the crime of murder which they are to commit. As with Tempuran edicts of war, this declaration must be made publically, to allow a state of preparedness to proceed between both sides. Thus allowing the innocent to seek sanctuary and warriors to bare arms.

Second, the cause of war must be for the pursuit of justice. Whereas justice is recognized as the force which avenges the wronged, when a state has to be punished for refusing to make amends for the wrongs inflicted by its subjects or to return which has been seized unjustly. The Tyrran interpretation for a war to be a punishment for refusing to make amends, leads to the proposition that peaceful negotiations must first be attempted through existing channels of law. If this is refused, then and only then, can war be declared.

Lastly, the warring state must have a righteous intent. So that they intend the advancement of good or the avoidance of evil. As St. Hargreve spoke, “the divine, look upon as peaceful those wars which are waged not for the motives of aggrandizement or cruelty, but with the object of securing peace, of lessening harm and uplifting the good.” This final condition affirms the laws of war which dictate the actions of those in combat. The righteous intent leads to the rules of proportionality and avoidance in war. That the good that is achieved by waging war must not be outweighed by the harm. Total destruction is not required if only a few need to be killed to achieve the war’s aim, and that warrior should only harm warrior, not the common folk, the land, or economy only for the sake of punishment or vengeance.

As with any actions of mortals, war is no different, thus laws are placed to govern right from wrong.
